<br />2743 Lake Court Drive <br />Mounds View, MN 55112 <br />February 25, 1992 <br /> <br />Mayor Vem Johnson <br />City of Roseville <br />2660 Civic Center Drive <br />Roseville, MN 55113 <br /> <br />Mr. Steve Sarkozy <br />City Manager <br />City of Roseville <br />2660 Civic Center Drive <br />Roseville, MN 55113 <br /> <br />Subject: Drainage Easement Vacation <br />1975 North Oxford Street <br /> <br />Dear Mayor Johnson and Mr. Sarkozy: <br /> <br />This letter is written to follow-up on the action taken during the January 13, 1992 <br />City Council meeting to vacate the drainage easement at 1975 North Oxford Street. <br /> <br />We would like to recap the events which led up to the action taken at that <br />meeting. <br /> <br />In September, 1991, we put our house up for sale. We had purchased the house <br />in November 1976, six months after it was built. It was sold in September, and closing was <br />set for October 25, 1991. Four days before the closing, we received a telephone call from <br />the realtor which we had secured to sell our house. She stated that there was a drainage <br />easement over our entire lot as well as the lots of our two neighbors, and before we could <br />have a closing on our house we must go to the City and apply for a vacation of that <br />easement. This was a result of the buyer's mortgage company's title search of our property, <br />and it was a condition of granting a loan to the buyer. The next day we went to the City <br />of Roseville offices and applied for vacation of the drainage easement. We did not raise any <br />questions because of the fear of jeopardizing the sale of our house. <br /> <br />Our closing took place on October 25, but because of the drainage easement, the <br />buyer's mortgage company held in escrow $500.00 from the sale, with the requirement that <br />we proceed immediately with the vacation procedure. Once accomplished, they would <br />fOlward the money in escrow to us, minus administrative fees. <br /> <br />In November, we received a telephone call from the City of Roseville stating that <br />we needed to notify either Ramsey County or a Title Company and provide them with a plat <br />map of the area surrounding our property, in order to secure from them a certified copy of <br />
