Oxford Street. <br /> <br />Backqround: <br /> <br />1. The Grove's are selling a home on the lot that was originally <br />part of a three lot drainage easement that was set aside in <br />the 1956 plat. <br /> <br />2. The City provided storm sewer to the area in 1970, <br />eliminating the need for the easement. <br /> <br />3. The Groves are selling their property and the easement <br />creates a title problem. <br /> <br />4. The Planning Commission unanimously recommended approval of <br />willard Grove's request for vacation of a drainage easement <br />at 1875 N. Oxford Street. <br /> <br />Alternatives: <br /> <br />1. Deny the vacation if the easement is still necessary. <br /> <br />2. Approve the vacation based on the finding that the easement <br />is no longer necessary because of the storm sewer constructed <br />in the area. <br /> <br />Policy Obiectives: <br /> <br />1. To maintain easements where necessary for storm sewer and to <br />vacate easements which are no longer necessary. <br /> <br />staff Recommendation: <br /> <br />1. It is recommended that the City council approve Willard <br />Grove's request for the vacation of an easement at 1975 North <br />Oxford street. <br /> <br />council Action Requested: <br /> <br />1. Motion to approve resolution vacating the drainage easement <br />at 1975 North Oxford Street. <br />
