Mr. Filister has operateã ~a~ apartment project for <br />over twenty (20) years, but did not, in ~e first instance, develop <br />and construct those bUildings. <br /> <br />Mr. Filis~er is now considering various al~ernatives for <br />~e ãevelopment of the vacant land which is part of the Rosedale <br />Estates property. Mr. Filis~er aãvises me that you have indicated <br />to Harvey Filis~er "there was an agreement" that the land in <br />question would remain vacant forever. <br /> <br />Inasmuch as Mr. Filis~er was not the initial developer of <br />the real estate, he was not a party to any negotiation that ensued <br />at the time appropriate approvals were obtained froID your ci~y. <br /> <br />If 'there is a requirement tha't the property remain <br />vacan~, and it is documented as part of the qranting of initial <br />zoning, consents, or conditional use permits, would you please <br />furnish copies to me of that documentation. Obviously, Kr. <br />Filister will be very much influenced by that which is a wri~ten <br />requirement that the presen~ property remain vacan~. <br /> <br />If, on the other hand, there is no such documentation, we <br />need to have a be~~er understandinq of what the City's position is <br />wi th respect to any development currently contemplated by the <br />Filister's. <br /> <br />SLK: bam <br /> <br />
