When the subdivision was platted, easements for storm <br />drainage were obtained for the two lots in question. <br />Subsequently, storm sewer was installed in the area, <br />eliminating the need for the easement. Houses were <br />subsequently developed on the parcels. However, the <br />easement remains in force and could result in potential <br />complications of the title to the property. <br /> <br />2. The Planning commission unanimously recommended approval of <br />the request to vacate the drainage and utility easements. <br /> <br />Alternatives: <br /> <br />1. Deny the vacation based on the finding that the easements are <br />still necessary. <br /> <br />2. Approve the vacation based on the fact that the easements are <br />no longer necessary. <br /> <br />Policy Obiectives: <br /> <br />1. To approve easement vacations where the easements are no <br />longer necessary. <br /> <br />staff Recommendation: <br /> <br />1. It is recommended that the City Council approve vacation of <br />the drainage and utility easements at 1045 and 1055 Ryan <br />Avenue. <br /> <br />Council Action Requested: <br /> <br />1. Motion to approve resolution vacating drainage and utility <br />easements at 1045 and 1055 Ryan Avenue. <br />
