BACKGROUND <br /> <br />When the Rose Acres Addition was platted an easement was acquired <br />by the City for storm drainage. Since then, the city has <br />installed storm sewer to serve the area, eliminating the need for <br />the easement, but the easement remains in force and is a potential <br />complication for title to the property. The owner of one of the <br />lots in question has asked for vacation of the easement. Last <br />year the city vacated the easement affecting Lot 4 of this same <br />subdivision at the request of that owner, Willard Grove (Case No. <br />2408). <br /> <br />In the past, the city has processed a number of these requests by <br />private land owners. When the City built the storm sewer <br />projects, it would have been reasonable to vacate the easements at <br />that time. The City Public Works Department has decided that from <br />now on the City will be the applicant and vacate the easements at <br />no cost to the land owner. <br /> <br />2. DEVELOPMENT ANALYSIS <br /> <br />Comprehensive Plan & Zoninq Code References <br /> <br />The property is guided LR Low Density Residential and is zoned <br />R-1. The request to vacate the easement does not affect the use of <br />the property from a zoning standpoint. <br /> <br />3. CONCLUSION & RECOMMENDATION <br /> <br />We recommend approval of the vacation request. <br />
