BACKGROUND <br /> <br />Mr. Al Kehr and his partners own three deep single-family lots on <br />county Road C on which they are proposing a residential PUD <br />consisting of 29 townhouse units, to be called Parkridge Estates. <br />The property is currently guided LR Low Density Residential and is <br />zoned R-1. The proposal requires a change in the Comprehensive <br />Plan Land Use designation to KR Medium Density Residential, and a <br />rezoning to Planned unit Development with an underlying zoning of <br />R-6 Townhouse District. <br /> <br />The project is related to one proposed by Mr. Kehr in 1985 on one <br />of the three lots. That proposal involved a rezoning to R-2, a <br />variance on density, and a special Use Permit for a PUD. Under <br />the current Code all of these issues can be handled within the PUD <br />process. The project consisted of 13 units on the westernmost lot <br />(1.55 acres) and was turned down by the City Council.. Mr. Kehr <br />then sued the city, asking for the rezoning to be granted. The <br />court ruled in the city's favor and the project did not go ahead. <br /> <br />since then, Mr. Kehr has acquired two more lots to the east of the <br />original lot, more than doubling the land area involved. The new <br />project is similar in character and density to the previous <br />project, and the units themselves are similar in size and design. <br />The earlier project was served by a single cul-de-sac drive; the <br />current project has a loop street with two access drives to County <br />Road C. The 1985 project was 8.4 units/acre, this project is <br />slightly less dense, at 7.9 units/acre. <br /> <br />We have met several times wi th Mr. Kehr and his archi tects to <br />discuss the overall layout and design of the project, noting on <br />several occasions that it is not guaranteed that this basic land <br />use will be approved in this location.
