The Borgeson's own a deep single family lot on Transit <br />Avenue. The property originally consisted of a lot fronting <br />Transit Avenue and an outlot on the rear. Subsequently, <br />Sextant Avenue has been built to the south providing access <br />to the outlot and the Borgeson's are proposing to redivide <br />the property to create a separate buildable lot on Sextant <br />Avenue. <br /> <br />2. The Planning Commission unanimously recommended approval of <br />Feryle and Betty Borgeson's request for division of platted <br />lot at 590 Transit Avenue with the following conditions: <br /> <br />a. That the applicant provide the City with a new <br />certificate of survey for the two lots prior to issuance <br />of a building permit or sale of either lot showing the <br />dedicated right-of-way easement for Sextant Avenue. <br /> <br />b. That no building permit be granted on the new lot until <br />the requirements of Resolution 870l are clarified and <br />met or modified to allow the construction on this lot. <br /> <br />Citv Attornev Comments: <br /> <br />1. After discussion with the City Manager, the City Attorney has <br />concluded that as long as any property on Sextant Avenue is <br />replatted in accordance with Exhibit A attached to Resolution <br />8701, building permits can be issued. <br /> <br />Alternatives: <br /> <br />1. Approve the proposed lot division based on the fact that it <br />meets all City standards for residential lots. <br /> <br />2. Deny the lot division based on a finding that the lot <br />division would be detrimental to the general health, safety, <br />and welfare. <br />
