<br />Slawik properties, Case No. 2490 <br /> <br />page 4 <br /> <br />Enaineerina Considerations <br /> <br />One condition requested by MnDOT in the vacation of the frontage <br />road adjacent to the Snelling Avenue right-of-way was to retain a <br />20' easement for future light rail transit. This has been shown <br />on the proposed plat. Slawik has agreed to dedicate this easement <br />with the understanding that if and when the easement is needed for <br />light rail purposes, Midway Ford will abandon all parking and <br />landscaping in the easement and they will relocate their parking <br />area 15' back from the easement. They could also apply for a <br />variance at that time for relief from the' setback requirement. <br /> <br />Another detail concerns a small sliver of land in the northeast <br />corner of new proposed Lot 1 (Midway Ford site) adjacent to the <br />snelling Avenue right-of-way. There is a question over the title <br />to this land as it was originally dedicated from the Gluek Estate. <br />Attorneys for Slawik are investigating and have indicated they <br />will have the matter resolved before the final plat is submitted. <br /> <br />There are a number of other engineering considerations related to <br />the relocation of utilities as a result of turning the public <br />frontage road back to private use. We have communicated these to <br />the applicant and they will address these in detail before the <br />final plat is submitted. <br /> <br />4 . CONCLUSION <br /> <br />The preliminary plat is a reasonable arrangement of lots to <br />accommodate the existing, proposed, and future development of the <br />area. We recommend approval of the request wi th the following <br />conditions: <br /> <br />1) All engineering work will be completed and approved by <br />City staff before the final plat is considered. <br /> <br />2) The 20' light rail transit easement will be dedicated <br />with the understanding that if it is needed for transit <br />purposes, all parking, landscaping, or other use of the <br />easement will be moved and the required ci ty front yard <br />setback to the easement will be provided. <br /> <br />3) The title question related to the Gluek parcel will be <br />resolved to the satisfaction of city staff before the final <br />plat is considered. <br />
