There is 66' dedicated currently and the County needs <br />99', or 16.5' from each side. The existing fence is on the <br />current right-of-way line. The edge of the green is about 40' <br />from the sidewalk and 50' from the vehicle lanes of Hamline <br />Avenue. <br /> <br />3 . CONCLUSION <br /> <br />The request for the fence height variance serves a public interest <br />by reducing the possibility of property damage, accident or injury <br />on Hamline Avenue. Adhering to the required 30' setback, <br />especially from the future right-of-way line, would pose a <br />hardship for the golf course, given the expense of moving or <br />removing a green. Given the history of the variance for the <br />adjacent parking lot, it is reasonable to allow the same treatment <br />here for the fence. The additional height of the fence will not <br />negatively alter the character of the Hamline Avenue streetscape. <br />We recommend approval of the variance request with the clear <br />understanding that the fence may need to be moved in the future if <br />additional right-of-way is needed for a Hamline Avenue widening <br />project. <br />
