When we had talked previously, your application <br />to the City was for used vehicles only. Since that use was not allowed by the Zoning Code under <br />your existing business arrangement, we removed your Special Use Permit request from the Planning <br />Commission agenda for November 10. If this was unclear, we apologize for the misunderstanding. <br />We will do what we can to keep you moving forward in the City process and to get hearings on your <br />requests as soon as possible. <br /> <br />You will note in the sections of the Zoning Code I sent you previously that both new and used vehicle <br />sales are by Special Pennit only in the 1-1 District. This means that you will need to apply to the <br />Planning Commission and City Council for pennission for MAG NET to operate as a new car dealer <br />at your location in Roseville. We will schedule this new request for ß¡e Planning Commission <br />meeting of December 9, 1992, if you are prepared for that meeting. <br /> <br />We want to assist you in whatever way we can to help your business contiPue and grow, but we also <br />need to be clear about the process and authority of the City Code. Your previous ~oposal was not <br />allowed by Code at all. With the addition of the MAG NET franchise for ñewêar sales, FLEET <br />SALES SYSTEMS can now apply for a Special Use Permit, but you are not guaranteed that the <br />request will be approved. <br /> <br />First, the change in use must confonn to City Code, as noted in the attached Section 11.020 of the <br />Code. As we discussed in our earlier meeting, the Code has a chapter called the "design standards", <br />which addresses the design and appearance of the property. A copy is attached Typical issues that <br />need to be addressed are paving and curbing, landscaping, screening rooftop equipment, and exterior <br />building materials. This means that in changing the use of the property to a new and used vehicle <br />dealer, the City can require you to bring the property into compliance with applicable regulations, <br />including the design standards. It is your responsibility to propose how you will meet these <br />standards, or if not, why not, and what you are willing and able to do to upgrade the property. The <br />City Staff will visit your site and give you a preliminary indication of th~specific issues that might <br />be involved in considering the desigJi 'Standards, but it is still your responsibility to know the Code <br />
