)4(IJ

REQUEST FOR COUNCIL ACTION

DATE: 11-23-92
ITEM NO.: Q - 3

Department Approval:

!5

Manager Reviewed:

Agenda section:

~

Hearings

Item Description:

James Krautbauer request for rezoning at 165
S. Owasso Boulevard.

Backqround:

1. James Krautbauer owns an existing dwelling and beauty shop
use at 165 S. Owasso Boulevard. The western half of the
property is zoned R-l Single Family Residential and the
remainder of the site is zoned B-3 General Business.

2. Mr. Krautbauer wishes to rezone the property to R-2 (2 family
dwelling) to allow him to convert the portion of the
structure utilized for the beauty shop into a second dwelling
unit on the site.

3. The Comprehensive Plan indicates that the si te should be
developed as LR low density residential. Two family
dwellings are consistent with this designation.

4. The Planning Commission, on a 5-0-1 vote, recommended that
the City Council approve James Krautbauer's request for
rezoning from B-3 and R-1 to R-2 with the condition that the
driveway width be brought into compliance with City codes
within three years. Mr. Krautbauer has objected to bringing
the driveway up to code because of the commercial development
on adjacent sites and because of the additional expense.

Alternatives:

1. Deny the rezoning based on the finding that the proposal
would be detrimental to the general health, safety, and
welfare.

2. Approve the rezoning based on the finding that the proposal
is consistent with the City's comprehensive plan.

Policy Obiectives:

1. To insure that development occurs consistent with the City's
comprehensive plan and zoning ordinance.
