Gary voqel, Case No. 2494

Page 2

with the design standards. The revised site will meet the required
parking setbacks, and landscaping will be provided, both in
internal green areas and on the Snelling Avenue boulevard.

2. DEVELOPMENT ANALYSIS

Planninq Considerations

The location of the existing fence and the proposed fence are
shown on the attached Fence Relocation Plan. As noted above, a
variance was granted to allow the existing fence, but not
immediately in front of the building on the east side. On the
existing site, this was relatively easy to accommodate, and there
are two gates in the fence for the driving aisle on the east side
of the building. On the reconfigured site, with an additional 80'
to 140' added to the east side of the lot, it would be much more
difficult to keep the fence opening in front of the building
across the additional parking area and driving aisles.

The key reason for the fence height request is security. Midway
Ford (and many other car dealers) experience significant theft and
vandalism. The fence provides a measure of protection. The
purpose of the fence height provision in the Code is primarily to
soften the visual impact of a fence. The question is how to
balance these two considerations, security and aesthetics.

The existing Midway Ford site is 6.57 acres and, in the new
configuration in the proposed plat, will be 6.95 acres, an
increase of less than 6%. Even though large areas of the site are
involved in the rearrangement, the overall increase in lot area is
slight. For this reason, we have determined that the changes in
the lot do not need to meet all the design standards, which
ordinarily come into play when 10% of the site is ~ffected.
Nevertheless, Midway Ford is providing internal green spaces in
the new parking area and overstory trees along the Snelling Avenue
frontage.

Enqineerinq Considerations

There are a number of engineering considerations related to the
relocation of utilities required because of the reconfiguration of
the site. These are not directly related to the fence question
and will be addressed in the final plat process.
