There <br />isalsoasewereasementonaportionthesouthedgeofthe <br />site, next toLarpenteur, which thedeveloperproposestoabandon <br />infavorplacinganew sewer line Drive.Thiswill <br />allow landscaping thefrontyardsfacingLarpenteurwithout <br />havingtostayoffofaneasement. <br />Thesewerlineonthenorth side thesitenotthe <br />easement,andthePublic Works Departmenthasconsentedtothe <br />easement being shifted tothenorthtoallowformorebuildable <br />areaon site, includingdecks on thebackthenortherlyunits. <br />Theeasement would remainwide. <br />WaterService.Theeasementonthenorthsidethesitefor <br />seweronly and theCitydoesnothavetheauthoritytoplacewater <br />serviceinthesameeasement without anadditional agreement with <br />theadjacent landowner to the eastofthissite.Thatownernot <br />willingtooffer such an agreementtothecurrent developer andthe <br />Citycannot force withoutcondemnation.However,therewater <br />servicethepublicrightofwayatLarpenteurandAlbans <br />whichthedeveloper proposes toextend at hisexpense within the <br />Larpenteur Avenue rightofwaytohisproperty.Both water and <br />sewercanbeprovidedtotheprojectwithoutany additional <br />agreementswiththeneighboring property owners. <br />ParksOpen Space <br />Park dedication fees intheamountofperunitwillneedtobe <br />paid. <br />FireMarshal Considerations <br />Thepavementtheculdesacturnaroundis proposed tobe <br />diameter,whichmeetstheminimumdimensions for fire trucks.The <br />lengthoftheculdesacovertheminimum,butinthiscase <br />thefarthestunit,attheendofEmeraldDriveonthenorthside, <br />lessthanfromLarpenteur Avenue tothesouth and lessthan <br />fromAlbansStreettotheeastforfireaccess.The <br />limitbasedonthefactthatfiretrucksusedtocarryonly <br />
