<br />.):b4 <br /> <br />MEMORANDUM <br /> <br />DATE: <br /> <br />May 14, 1993 <br /> <br />TO: steve Sarkozy <br /> <br />FROM: Rick JOPke~ <br /> <br />SUBJECT: Vacation of Richmond Avenue, between county Road C-2 <br />and Millwood Avenue <br /> <br />At the May 10, 1993 City council meeting, the Council considered <br />passing a resolution to amend a previous Council approval <br />concerning the vacation of Richmond Avenue, between County Road <br />C-2 and Millwood Avenue. The City Council continued action on <br />the request until the May 24, 1993 City Council meeting. The <br />Council also referred the matter for additional discussion at the <br />May 17, 1993 Work Session. The main area of concern expressed <br />was whether or not the vacation of the right-of-way would <br />preclude future access to the back part of the deep lots that are <br />abutting both Millwood and county Road C-2. This access would be <br />necessary to allow the owners of these deep lots to split or <br />subdivide their property in the future. <br /> <br />The current proposal is to only vacate the south half of Richmond <br />Avenue between Millwood and County Road C-2. The north half <br />would remain as dedicated right-of-way. As can be seen from the <br />attached drawing, it would be possible to construct a road on the <br />north half of the Richmond Avenue right-of-way and then run an <br />additional east west street connecting to that right-of-way which <br />could provide access to the back of the lots. The length of this <br />cul-de-sac would be approximately 830 feet. This would exceed <br />the city subdivision regulation standard of 500 feet. The city <br />may, however, want to not vacate the north 30 feet of the south <br />half of Richmond Avenue so that the road could be centered on the <br />rear property lines of the lots on Millwood and County Road C-2. <br />In reviewing the grades of the area, it is also apparent to staff <br />that there would be a steeper grade for the roadway coming from <br />the south then there would be from the north. This could mean <br />that the cost for developing the roadway would actually be less <br />if access is brought in from Millwood Avenue versus County Road <br />C-2. <br /> <br />There is a wetland that has been identified on the National <br />Wetlands Inventory produced by the Uni ted States Department of <br />I11terior in the rear of a number of the lots on the west end. <br />This would not only severely restrict the ability of a number of <br />property owners to split off and develop the rear parts of their <br />lots but would also restrict the City's ability to provide a <br />roadway. preliminary discussions with representatives from the <br />Minnesota Department of Natural Resources have confirmed this <br />fact. Further investigation would be necessary to establish the <br />exact location and limits of this wetland. It has also come to <br />I <br /> <br />~ <br /> <br />-- <br />
