owners be notified of the new proposal and the hearing
scheduled for November 22, 1993. Notices had been sent to the
surrounding property owners inviting them to attend the Council
meeting or to submit their written comments to City Hall. Any
comments received prior to the Council meeting will be
presented Monday evening.

staff Recommendation:

1. The City Council has had this request for a special use permit
at 1975 Oakcrest Avenue under consideration for some time. The
proposal has been modified from its original form where Boyer
Ford Trucks would simply move into the facility and begin their
operation with no improvements to improving the building and
site over a five year time frame to its present configuration
as a 10 year interim use permit with the site and building
improvements being accomplished immediately. At this point,
staff is of the opinion that the City Council has been more
than generous in the amount of time allocated to this request
and the time spent listening to the applicant and gathering
input from surrounding neighbors. We have included Mr.
Henderson's letter indicating Interstate Detroit Diesel's
proposal for an interim use and the resolution stating findings
of fact consistent with denial prepared by city legal counsel
for your consideration. The City Council can either approve
the interim use permit or adopt the resolution denying the
application.

Council Action Requested:

1. Motion to approve the attached resolution denying Boyer Ford
Trucks request for a special use permit at 1975 Oakcrest
Avenue.

2. Motion to approve Boyer Ford Trucks request for a 10 year
interim use permit with the site and building improvements
being accomplished immediately at 1975 Oakcrest Avenue.

staff Report by: Michael Falk
