<br />REQUEST FOR COUNCIL ACTION <br /> <br />DATE: 11-08-93 <br />ITEM NO.: (! ...,10 <br /> <br />Deu;;~oval: <br /> <br />Manager Reviewed: <br /> <br />Agenda section: <br /> <br />~ <br /> <br />Hearing <br /> <br />Item Description: <br /> <br />Boyer Ford Trucks request for a special use <br />permit at 1975 Oakcrest Avenue. <br /> <br />Background: <br /> <br />1. At the September 27, 1993, City Council meeting, the City <br />Council considered a request from Boyer Ford Trucks for a <br />special use permit at 1975 Oakcrest Avenue. Staff's <br />recommendation, at that time, was for a 10 year interim use <br />permit subject to making improvements to the site and building <br />immediately rather than the five year timeframe originally <br />proposed. <br /> <br />2. The City Council directed the City Attorney's office to prepare <br />the appropriate resolution stating findings of fact to support <br />the denial of this request. <br /> <br />3. The attached resolution has been received from the City <br />Attorney's office, stating that the use is not specifically <br />listed as a "special use" in an I-1 zone, and describing the <br />inconsistencies with the Comprehensive Plan and proposed 10 <br />year interim use. <br /> <br />4. At the October 11, 1993 City Council meeting, a representative <br />from Interstate Diesel asked the city Council to continue <br />consideration of the resolution to the November 8, 1993 <br />meeting. The purpose of the delay was to allow time for the <br />applicant to develop a proposal that "everyone would be happy <br />with". Since that meeting, staff has remained in contact with <br />the applicant but, as of this writing, no new proposals have <br />been forthcoming. <br /> <br />5. At the November 8, 1993 City council meeting, Attorney Lee <br />Henderson, representing Interstate Detroit Diesel, indicated by <br />I <br />the attached letter that the owners new proposal was to ask for <br />a 10 year interim use permit and to make all the previously <br />agreed to improvements to the site and building immediately <br />rather than over a five year time frame. The improvements <br />include replacing the building's metal exterior walls with <br />stucco wall surfaces, paving and concrete curb and gutter for <br />the parking areas, and landscaping in the front of the building <br />and seeding the remainder of the site. The City Council <br />continued this hearing and asked that neighboring property <br />
