Backaround: <br /> <br />Rosedale Amoco is proposing to add a 32 ft. by 50 ft. canopy <br />over their fuel pump islands at their site at 2441 N. <br />Fairview Avenue (Northwest quadrant of County Road B-2 and <br />Fairview). The property is zoned I-I light industrial and <br />the minimum front yard setback in this district is 40 feet. <br />The City Code applies design standards to canopies in the <br />same manner as principal structures. <br /> <br />2 . Develo-pment Snmmarv <br /> <br />The proposed fuel island Canopy is illustrated on the <br />attached site plan and canopy elevations. The proposed <br />canopy would be 50 ft. wide and 32 ft. long. The site plan <br />indicates that the East edge of the canopy overhang would be <br />27 ft. from the existing property line and 17 ft. from a new <br />property line following a proposed right of way taking for <br />Fairview Avenue. Past practice has been to recognize the <br />customer convenience of canopies during city reviews of such <br />applications and to be flexible when considering setback <br />requirements on existing sites. Prior to the right of way <br />taking on Fairview Avenue the setback variance would be 13 <br />ft. following the taking the setback variance would be 23 <br />ft. The structure itself is set back from the intersection <br />of County Road B-2 and Fairview and with it's 14 ft. <br />minimum clear height will not pose any visibility <br />obstructions at the intersection. At this time the <br />applicant has indicated that they would like to have some <br />signage on the canopy however, they have not refined their <br />signage program as of this writing and will need to apply <br />for signage at a later date. <br /> <br />The Engineering Staff has reviewed this proposal and has <br />indicated that the Ramsey County Master Road Plan shows a 99 <br />ft. need for right of way for both Fairview Avenue and <br />County Road B-2. This means that an additional 9.5 ft of <br />right of way is required from this site from County Road B-2 <br />and an additional 6.5 ft. of right of way will be required <br />
