The stated purpose of the ordinance is to preserve <br />and enhance the quality of surface waters, preserve economic <br />natural environmental values of shorelands, and provide for the <br />wise utilization of waters and related land resources. The <br />ordinance contains many criteria and standards to control the <br />use of shorelands within the City of Roseville, most notably <br />setback requirements from the ordinary high water line of <br />public waters. <br /> <br />In a fashion similar to the zoning ordinance, the shoreland <br />management ordinance provides for uses of shorelands in <br />existence prior to the date of enactment of the ordinance that <br />do not meet minimum lot area, setbacks, or other dimensional <br />requirements of the chapter. This section of the ordinance <br />also states that any alteration or addition to a substandard <br />use which will increase the substandard dimension shall not be <br />allowed. - <br /> <br />Mr. Kadrie1s home, located at 1281 Jos~ne Road, was built in <br />1967. It was constructed wi~o de~ one at grade level <br />and one on the first floor le~-- The princiþal structure is , <br />located 37 feet from the shoreline and the 1(8 gJ;a.de dec.k, is* <br />located within 15 teet of the shoreline. <br /> <br />\/J <br /> <br />In August of 1988, Mr. Kaclrie applied for, and received, a <br />shoreline permit from the Roseville èity Council to locate an <br />addition between the house and the free standing garage. It <br />did not bring the house closer to the shoreline. In 1991, Mr. <br />Kadrie applied for the building permit for this addition to his <br />heme (building permits are good for one year). Attached to <br />this permit were plans that showed a proposed expansion of the <br />kitchen area onto the existine first floor deck with a new deck <br />being extended beyond this addition. Based on permit <br />valuation, and past approvals, it is clear that the building <br /> <br />L.. <br />
