Based on his belief that he could expand his home toward the <br />lake, as long as he did not cross the vertical plane of the at <br />grade deck closest to the lake, Mr. Kadrie began construction <br />of the kitchen addition. In July, 1993, Building inspection <br />staff noticed the construction and stopped it until the issue <br />of valid building permits and shoreline setbacks could be <br />resolved (building permits are valid for one year). <br /> <br />6. Staff's interpretation of the shoreline management ordinance <br />would allow Mr. Kadrie to extend his kitchen only to the limits <br />of the existing first floor deck. It is staff's feeling that <br />j extending a new deck beyond this point should be interpreted as (' <br />~ increasing a substandard dimension and therefore, is prohibited <br />~_ by ordinance. Staff further interprets the code to limit <br />r further enroachment on the lower level beyond the existing <br />_ _~~ structural wall (the at grade deck is not considered to be an <br />X ~V 1f- integral structural element). Mr. Kadrie' s view is that the <br />N\~~'\if\Y limits of the lower at grade deck established that point beyond <br />~ which substandard dimensions cannot be allowed and is asked the <br />~ Council, as the Board of Zoning Appeal, for an interpretation <br />on this matter. At their meeting of August 23, 1993, the City <br />Council interpreted the provisions of Section 18 of the <br />Roseville zoning code (Shoreland Management Ordinance) in a <br />manner that defines the structural wall of the house as that <br />point beyond which construction could not occur without first <br />applying for a variance. <br /> <br />7. The Planning commission, on a 5-1 vote, moved to recommend <br />approval of a 10 foot 6 inch variance to the shoreland <br />management ordinance for the Kadrie kitchen expansion and to <br />recommend denial of a variance for a deck that would extend <br />closer to the lake then the kitchen addition. <br /> <br />policv Ob;ectives,: <br /> <br />1. It is recommended that the City Council approve a 10 foot 6 <br />inch variance to the Shoreland Management Ordinance for the <br />Kadrie kitchen expansion and to deny the variance request for <br />the proposed deck that would extend closer to the lake than the <br />kitchen addition. It is further recommended that the code be <br />interpreted to limit further encroachment on the lower level <br />beyond the existing structural wall of the house. A building <br />permit for this addition needs to be applied for prior to any <br />further work being completed. <br />
