<br />REQUEST FOR COUNCIL ACTION <br /> <br />DATE: 1/23/95 <br /> <br />ITEM NO.: E-2 <br /> <br />Department Approval: <br /> <br />Manager Reviewed: <br /> <br />Agenda section: <br /> <br />Reports and Recommendations <br /> <br />Item Description: Motion to initiate a civil proceeding against <br />Charles Kadrie requiring Charles Kadrie to comply <br />with the Lakeshore Zoning Ordinance of the City of <br />Roseville. <br /> <br />Background <br />City Council has had the opportunity to discuss this matter at the <br />January 17 City Council work session. At that time, City Attorney Bob <br />Bell was directed to prepare a motion initiating the civil action. <br /> <br />Attached is the correspondence from City Attorney Bob Bell and the <br />appropriate motion. <br /> <br />Financial Implications <br />Costs for civil actions are over and above the City Attorney's civil <br />retainer. Costs of such civil procedures are uncertain at the outset. <br />However, the city Council should appropriate $10,000 from the 1995 <br />General Fund Contingency Account to initiate this legal action. This <br />appropriation should be made with the understanding that costs may be <br />significantly higher in the final outcome. <br /> <br />COUNCIL ACTION REQUESTED: <br /> <br />Motion to authorize the attached motion offered by City Attorney Bob <br />Bell to initiate civil action against Mr. Charles Kadrie. <br /> <br />Motion to authorize the transfer of $10,000 from the 1995 General <br />Fund Contingency Account to cover these expenses. <br />
