The City of Roseville has done nothing wrong. Mr. Kadrie's
request for a variance was validly denied based upon the Zoning
Code.

CONCLUSION

Mr. Kadrie is seeking redress from the courts for his mistake.
The Roseville Zoning Code is clear; increases in the dimensions of

substandard uses is prohibited. The City is not creating new rules
for Mr. Kadrie, it is simply enforcing the existing laws.

Mr. Kadrie's addition of a first level deck is an increase in

the dimensions of the substandard use and therefore is in violation

of the Roseville Zoning Code.

PETERSON, BELL, CONVERSE &: JENSEN,
P.A.

Dated: October 21, 1994

By
Caroline
Attorneys for the Plaintiff
3000 Metropolitan Centre
333 South Seventh Street
Minneapolis, Minnesota 55402
(612) 342-2323

/u/dyanno/wp/kadrie

7
