<br />18.080 <br /> <br />ZONING CODE <br /> <br />4. "Natural Environmental Conservation Area" (NECA) is an area <br />of land or water which contains within its boundaries <br />conditions deemed desirable to be retained in the public <br />interest due to its aesthetic and/or ecoloqical value to <br />the public. Such conditions shall include natural wetlands <br />éapable of sustaininq aquatic life, veqetation, substantial <br />tree qrowth, and other natural liyinq qrowth contractinq <br />with typical manmade urban development. Such areas shall <br />include' all undeveloped lands within 300 feet of public <br />waters and all other areas adjacent to other lakes, ponds <br />or wetlands hereafter desiqnated as such by resolution of <br />the Council. <br /> <br />s. "Nonconforminq Use" means any use of land established <br />before the effective date of the City Ordinance which does <br />not conform to the use restrictions of a particular zoninq <br />district. <br /> <br />6. "Nor1nal Hiqh Water Mark" means a mark delineatinq the <br />hiqhest water level which has been maintained for a suffi- <br />cient period of time to leave evidence upon the landscape. <br />The normal hiqh water mark is commonly that point where the <br />natural veqetation chanqes from predominantly aquatic to <br />predominantly terrestrial. <br /> <br />7. "Public Water" means a body of water capable of substantial <br />beneficial public use. For the purpose of this chapter, <br />this shall be construed to mean any lake, pond or wetlands <br />within the City of Roseville of five acres or more in size. <br /> <br />8. "Setback" means the minimum horizontal distance between a <br />structure and the normal hiqh water mark, or between a <br />structure and a road or hiqhway. <br /> <br />9. "Shoreland" means that land located contiquous to any <br />public waters as herein before defined. <br /> <br />1.0. "structure" means any building or appurtenance thereto, <br />except aerial or underground utility lines such as sewer, <br />electric, telephone, teleqraph, or qas lines includinq <br />towers, poles and other supportinq appurtenances. <br /> <br />11.. "Subdivision" means improved or unimproved land or lands <br />which are divided for the purpose of ready sale or lease, <br />or divided successively within a five year period for the <br />purpose of sale or lease into three or more lots or parcels <br />of less than five acres each contiguous in area, and which <br />are under common ownership or control. <br /> <br />102 <br />
