City of Roseville <br />CC: Dennis Welsch, ~ F~ <br /> <br />On January 29, Judge Flynn of Ramsey County District Court supported the City's <br />claim of a violation of the setback requirements of the Shoreland Ordinance and <br />ordered Kadrie to remove portions of his new deck. <br /> <br />On Friday, Will Converse of the City Attorney Office received notice of an upcoming <br />appeal. Councllmembers may be contacted by Mr. Kadrie regarding this issue, <br />according to Mr. Converse. The attached memo from Dennis Welsch provides <br />additional detail. Should additional information be needed please call. <br /> <br />Mr. Kadrie has exhausted his appeal option before the City Council, unless <br />Councilmembers choose to reconsider the issue. <br /> <br />An appeal may take four (4) to five (5) months. We would not take any action to have <br />the deck removed until the appeal process is complete. Mr. Converse remains quite <br />confident that the City will continue to prevail in appeal. <br /> <br />Respectfully submitted. <br />
