REQUEST FOR COUNCIL ACTION DATE: 11-22-93 ITEM NO.: C, - I Depart~pproval: Manager Reviewed: Agenda section: ~ Hearing Item Description: Robert request drainage 565, and Levine/Palisades Limited Partnership for vacation of right-of-way and and utility easements at 535, 550, 570 Sandhurst Drive. Background: 1. Palisades Limited Partnership, the owner of Palisades Apartment project on Sandhurst Drive, have made a request to the City for the vacation of certain utility and drainage easements in public right-of-way within the apartment project property. The purpose of the request is to clear up certain title defects where encroachments to these easements exist. In all, there are 11 areas within the project where encroachments must be addressed. Engineering staff has reviewed these and have found all but one to be appropriate for vacation proceedings. The one area where they have concerns involves rewriting a utility and drainage eas.ement describing the area where a City sanitary sewer main crosses through the project. Because this description needs to be first looked at by a registered surveyor and then prepared for recording~ staff suggests that this public hearing be continued to the December 13, 1993 City Council meeting. 2. The Planning Commission, at the November 10, 1993 meeting, continued consideration of this request to the December 9, 1993 regular Planning commission meeting. Staff Recommendation: 1. Staff recommends that· the application of Robert Levine/Palisades Limited Partnership for the vacation of right- of-way and utility and drainage easements at 535, 550, 565, and 570 Sandhurst Drive be continued to the City Council meeting of December 13, 1993.
