Pal isades Limited Partnership, the owner of Pal isades Apartment <br />project on Sandhurst Drive, have made a request to the City for <br />the vacation of certain utility and drainage easements and <br />public right-of-way within the apartment property. <br /> <br />2. The purpose of the request is to clear up certain title defects <br />where encroachments to these easements exist. In all, there <br />are 11 areas within the project where encroachments must be <br />addressed. <br /> <br />3. The Engineering staff has reviewed these and found all but one <br />to be appropriate for vacation proceedings as presented by the <br />applicant. The one area where they have concern involves an <br />encroachment of a building to a City maintained sanitary sewer <br />main. Due to the depth of the main, it is Engineering's <br />feeling that if the city needed to replace or repair the line <br />at this location, there would be an additional expense involved <br />to protect the building from any damage due to excavation. <br />with this in mind, the City's legal council has prepared an <br />agreement whereby present or future owners of the Palisades <br />Apartment would pay for any additional expense required to <br />protect the footings and the wall of the building at 550 <br />Sandhurst Drive should work in that area be necessary. This <br />agreement, once signed by the owner and by the City of <br />Roseville would be recorded at the Ramsey County recorder's <br />office. with this agreement in place, the Engineering <br />Department is comfortable with the proposed vacation of <br />easements for this project. <br /> <br />2. The Planning Commission, at their December 9, 1993 meeting, <br />considered this request. Because of the change in the meeting <br />date of the Planning commission meeting, the motion on this <br />application will be presented at the December 13, 1993 City <br />Council meeting. <br />
