<br />PLANNING REPORT: <br /> <br />DATE: <br /> <br />December 9, 1993 <br /> <br />CASE NUMBER: <br /> <br />2619 <br /> <br />APPLICANT: <br /> <br />Robert LevineIPalisades Limited Partnership <br /> <br />LOCA TION: <br /> <br />535, 550, 565, 570 Sandhurst Drive <br /> <br />ACTION REQUESTED: <br /> <br />Vacation of right-of-way and drainage and utility <br />easements. <br /> <br />1. BACKGROUND <br /> <br />Palisades Limited Partnership, the owner of Palisades Apartment project <br />on Sandhurst Drive, have made a request to the City for the vacation of <br />certain utility and drainage easements and public right-of-way within the <br />apartment property. The purpose of the request is to clear up certain title <br />defects where encroachments to these easements exist. In all, there are 11 <br />areas within the project where encroachments must be addressed. The <br />Engineering staff has reviewed these and found all but one to be <br />appropriate for vacation proceedings as presented by the applicant. The <br />one area where they have concenl involves an encroachment of a building <br />to a City maintained sanitary sewer main. Due to the depth of the main, <br />it is Engineering's feeling that if the City needed to replace or repair the <br />line at this location, there would be an additional expense involved to <br />protect the building ITom any damage due to excavation. With this in <br />mind, the City's legal Council has prepared an agreement whereby present <br />or future owners of the Palisades Apartment would pay for any additional <br />expense required to protect the footings and the wall of the building at <br />550 Sandhurst Drive should work in that area be necessary. This <br />agreement, once signed by the owner and by the City of Roseville would <br />be recorded at the Ramsey County recorder's office. With this agreement <br />in place, the Engineering Department is comfortable with the proposed <br />vacation of easements for this project. <br /> <br />CONCLUSION AND RECOMMENDATION <br /> <br />Staff recommends that the application of Robert Levine/Palisades Limited <br />
