Alladin's Castle is proposing to add a family entertainment <br />center to the Rosedale Mall, to add to the total experience of <br />mall shoppers who are increasingly expecting entertainment to <br />be available as a part of the shopping experience. In the <br />shopping center zoning district, such entertainment centers can <br />be considered by special use permit. Section 109 of the <br />Roseville city Code also requires annual licenses for amusement <br />devices. This section of the code defines a "gameroom" as a <br />business establishment where more than 50% of the gross <br />receipts are derived from the operation of amusement devices. <br />Special requirements for licensing of gamerooms are also <br />included in this section of the code. Most notable is the <br />requirement that gamerooms be at least 1500 feet from any <br />resident, school building, or park. Alladin's Castle proposal <br />meets this definition and must be considered a gameroom <br />business. <br /> <br />2. Alladin's Castle is proposing to open a 6755 sq. ft. family <br />amusement center as a part of the interior mall at Rosedale <br />Shopping Center. No addi tiòn to the shopping center or <br />exterior remodeling is proposed as a part of this application <br />for a special use permit. Because no additional space is being <br />proposed, no additional demand for parking at the center would <br />be required. <br /> <br />3. Section 109.030 of the city Code states that no license shall <br />be granted for any gameroom which is less than 1500 feet from <br />any residence, is less than 1500 feet from any school building <br />or school yard, or is less than 1500 feet from any park. This <br />distance is to be measured from the licensed premises to the <br />property line of any parcel used for residential, school <br />building/yard, or park. Given this distance requirement, an <br />interpretation of this section of the code would lead to the <br />conclusion that gamerooms were intended to be limited to <br />regional facilities such as the Rosedale Shopping Center with <br />its expanse of parking area and the peripheral commercial <br />
