For purposes of continuity, when dealing with corner lots <br />having frontage on two public streets, the Roseville zoning <br />ordinance defines the front yard as that side of the lot that <br />has the narrowest street frontage. Rear yard and side yard <br />setbacks then, are determined by this technical definition. <br /> <br />2. The Palke's home, at 1775 Shorewood Curve, is located in the <br />northwest corner of Wheeler st. and Shorewood Curve. It has 95 <br />feet of frontage on Shorewood Curve and 180 feet of frontage on <br />Wheeler Street. By definition then, Shorewood Curve is the <br />front yard of this lot. The house, however, is oriented toward <br />Wheeler st. and setbacks were figured based on Wheeler street <br />frontage. This means that was is technically a rear yard <br />setback area has been treated as a side yard setback area and <br />vice versa what is technically a side yard setback area has <br />been used as the rear yard. <br /> <br />3. The palke's are proposing an addition to the house that would <br />include a new porch and spa area, together with a deck <br />extending from the northeast corner of their home. The design <br />of the addition was based on the north property line being the <br />side yard and the east property line being the rear yard. With <br />that configuration, no variances would have been required. <br />However, with the technical definition of the lot, a rear yard <br />setback variance would be required for this addition to be <br />built. <br /> <br />4. In reviewing this application for a variance, the Minor <br />Variance Committee considered other factors than the location <br />and orientation of the house on the lot. Specifically, the <br />Committee noted that the topography of the lot drops off to the <br />north and east making it difficult to move the addition further <br />away from the north property line. In addition, moving the <br />project to the east would cover existing kitchen windows and <br />would preclude an access door to the addition. Moving the <br />addition would also necessitate modifying the roof line for the <br />design. Based on these hardships, the Minor Variance 'Committee <br />unanimously recommended approval of a 17 foot rear yard setback <br /> <br />I <br />
