<br />" <br /> <br />þ <br /> <br />And that part of the above West half which lies within a circular cul-de-sac 100 feet in <br />diameter, the center of which is located on the Easterly boundary of said property distant <br />419.52 feet South of the North line ofthe west half Southwest quarter of the Northeast <br />quarter of southwest quarter of said Section 12. <br /> <br />Document No. 1716354: Except the North 30 feet, the West 25 feet of the following <br />described property: the North half of the East two acres of the West half of the Southwest <br />quarter of the Northeast quarter of the Southwest quarter of Section 12, Township 29, <br />Range 23 West. <br /> <br />WHEREAS, the Roseville City Council held a hearing regarding the roadway easement <br />vacation on May 23,2994 and determined the roadway easement should be vacated; and, <br /> <br />WHEREAS, the necessary approved roadway easement documents were not recorded <br />within the required six month time line and became null and void; and, <br /> <br />WHEREAS, Section 1013.04 of the Roseville Zoning Ordinance outlines the procedure <br />for vacation of street or ally ways; and, <br /> <br />NOW, THEREFORE BE IT RESOLVED, by the City Council (the "Council") of the <br />City of Roseville, Minnesota (the "City"), Ramsey County, Minnesota, that roadway easement <br />documents number 2191187, 1579619 and 1716354 covering a portion of Cohansey Street <br />between Lovell Avenue and Minnesota A venue, be vacated, subject to: <br /> <br />A. <br /> <br />Easements for public or private purposes, including, but not limited to, <br />water lines, sewer mains, telephone lines and poles, gas and electric, and <br />cable television lines, including the right to maintain the same or enter <br />upon such land or portion thereof vacated, to maintain, replace, remove, <br />or otherwise attend thereto, existing on the date of this vacation, shall be <br />preserved and maintained by said utility holder pursuant to Minnesota <br />Statute Section 160.29. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Council Member <br />Mastel, and upon vote being taken thereon, the following voted in favor: Mastel, Goedeke, <br />Maschka, Wiski and Kysylyczyn <br />and the following voted against the same: None <br /> <br />WHEREUPON, said resolution was declared duly passed and adopted. <br />
