'" .,. ... ... $ !II * * *- * Pursuant to due call and notice thereof, a meeting of the City Council of the City ofRoseviHe, County of Ramsey, Minnesota was duly held on the 23rd day of May, 1994 at 5:30 P,M. The following members were present: P. Johnson, Wiski, Mastel, Goedeke and V. Johnson and the following were absent None, Member p, Johnson introduced the following resolution and moved its adoption: RESOLUTION NO,9 0 8 0 RESOLUTION RECOMMENDING V ACA TION OF RIGHT OF WAY EASEMENT AT 480 LOVELL AVENUE WHEREAS, the City Council held a public hearing to detennine whether or not said portion of right- of·way easement in the City ofRoseviUe should be vacated; and WHEREAS, because the portion of right-of-way easement at 480 LoveH Av~nue is not necessary for public purposes~ and WHEREAS, it would be beneficia) to the public interest to vacate said right-of.way easement as described in Attachment n AI!, NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Roseville hereby vacates the right-ofwway easement at 480 Lovell Avenue described in Attachment "N\ except easements for public or private utilities, including but not limited to water lines, sewer mains, telephone lines and poles, gas and electric lines and cable TV lines, including the right to maintain the same or to enter upon such land or portion thereof vacated, to maintain, repair, replace, remove or otherwise attend thereto, existing on the date of this vacation, shall be preserved and maintained by said utility holder pursuant to Minnesota Statutes Section 160.29. The motion for the adoption of the foregoing resolution was duly seconded by Member Goedeke, and upon a vote being taken thereon, the following vote in favor thereat: P. Johnson, Wiski, Mastel, Goedeke, and V. Johnson and the following voted against the same: None. WHEREUPON said resolution was declared duly passed and adopted.
