Before and during the October 24th Council meeting, the staff received a number of <br />comments regarding the changes to the shoreland ordinance revisions. Consequently, staff <br />requested a continuation of the Council Hearing until we could do more research and <br />review possible changes with the Planning Commission. <br /> <br />2. At the November 9th Planning Commission meeting, staff asked the Commission for their <br />comments and concurrence regarding the following items in the proposed code: <br /> <br />a. A definition of "storm water pond" should be included in this code (page 7) for <br />clarification or referred to the Public Works staff storm water management design <br />guidelines. Definition: A "storm water pond" means a man-made pond capable of <br />holding water seasonally or permanently, the purpose of which is to collect run off, <br />nutrients, and sediment prior to releasing water into wetlands and natural water <br />bodies. <br /> <br />b. It was not reasonable to require a 60 foot setback £rom DNR and City/Public <br />Water Body or a wetland for a public road and parking surfaces. (page 13, Section <br />18.045.2). A more consistent approach is a 30 foot setback from the road or <br />parking surfaces (15 feet within the right-of-way and 15 feet of additional setback <br />beyond the right-of-way or any combination thereof) with landscape screening, as <br />well as curb and gutter which controls run-off and sediments. <br /> <br />c. It was not reasonable to require a 50 foot setback from man-made ~ ponds <br />(page 13, Section 18.045.2). Comments from citizens, developers, and our <br />engineers made this seem illogical and unworkable on smaIl urban lots. An example <br />is the pond along the east side of the new retail building at HamIine and "C". <br /> <br />A more workable approach may be a 10 foot building foundation wall and <br />pavement setback from any man-made storm water pond. <br /> <br />I <br />
