Pedestrian trails shall be exempt from setback requirements.

d. Clarification should be considered for the bluff land definition and setback as well
as the vegetation cutting section. This will be done through a handout after
adoption. A number ofDNR handouts are already available.

e. Clarification should be considered regarding how the shoreland (DNR) standards
apply within the wetland and storm pond areas. For example, one resident asked
whether bluff land owned within a wetland setback area may be built on and/or
have vegetation cut differently than in a shoreland area. Water quality and quantity
control is the main reason for this ordinance, therefore all wetlands and ponds
should also be protected by this ordinance, but the actual setback requirements will
be different. Structures cannot be placed on the steep slope bluff land. (See
Section 18.045.3).

f. While not part of this proposed ordinance, at some point in the process, the
Commission and Council should discuss the differences in "no wake" buffer
between Shoreview and Roseville.

Shoreview amended its ordinance to reduce the "no wake II buffer from 300 feet to
150 feet of the shore of any lake.

Rosevillets code, Section 88.040 through 88.060 states that when a motor boat
passes within 300 feet of any shoreline ... the operator shall ... throttle down his
speed ..." (no mention is made of the words Uno wake buffer".

Suml\lary:

Through the summer and fall of 1994, there have been numerous public hearings and comments
received. The ordinance has been studied by planning staff, the Public Works Director, and the

2
