<br />, " <br /> <br />(B) Lot Standards: <br /> <br />(1) The owner of the lot does not currently or did not <br />previously own Ot control ownersn~p of adjacent <br />property which could have been used to avoid the <br />nonconformity; <br /> <br />(2) The width or area of the lot is at least equal to <br />75% of the current width or area requirements; <br /> <br />(3) Such lot abuts an improved public right-of-way or <br />if the lot was legally accessed via a private way <br />prior to December 10, 1992. said access mav <br />continue to be utilized, provided: there is n~ <br />practical way to extend a public street to the <br />property; ,said private access is protected by a <br />permanent easement recorded to run with the title <br />of the property; andr the drive complies with the <br />fire apparatus access requirements set forth in the <br />Uniform Fire Code. <br /> <br />(C) Design Standards: Any structures constructed or <br />expanded on a substandard lot shall comply with the <br />following design requirements, in addition to the <br />standards set forth in this Chapter. <br /> <br />(1) Lot coverage shall not exceed 30 percent. <br /> <br />(2) The height of the proposed dwelling shall not <br />exceed the average height of existing dwellings <br />located tvo lots to each side of the subject lot. <br /> <br />(3) The foundation area for the proposed dwelling shall <br />not be larger than 105 percent of the average <br />foundation area fòr similar-style homes in the <br />neighborhoodr as determined by the City. <br /> <br />(4) The front and rear yard dwelling setbacks shall not <br />be less than the average of such setbacks of <br />dwellings located up to four lots to each side of <br />the subject lot butr in no caser shall the proposed <br />setbacks be more than ten feet in front or of <br />behind the established setbacks of an adjoining <br />dwelling(s). <br /> <br />(5) The architectural design and mass of the structure <br />is determined by the City to be compatible with the <br />existing neighborhood character. <br /> <br />200-169 <br />
