<br />2.254 Wetland. "Wetland') means a land form that is transitional between terrestrial and aquatic <br />systems as defined in Minnesota Statutes, Section 1030,005, Subd. 19. <br /> <br />2.255 Wetland boundary. "Wetland Boundary" means the boundary line between what is <br />considered to be upland and wetland using the methodology for delineating wetlands as <br />prescirbed in Minnesota Statutes, Section 103G.2242, Subd. 2. <br /> <br />2.3 Disclaimer <br /> <br />This Chapter does not imply that areas outside of the Water Management Overlay District or land <br />uses permitted within that district will be free ftom flooding or flood damages. The Chapter does <br />not create liabmty on the part of the City or its officers or employees for an flood damage that <br />may result trom reliance on this Capter or any administrative decision made under it. <br /> <br />2.32 Enforcement Compliance <br /> <br />2.4 Interpretation <br /> <br />In their interpretation and application, the provisions of this ordinance shall be held to be <br />minimum requirements and shall be liberally construed in favor of the governing body and shall <br />not be deemed a limitation or repeal of any other powers granted by Stat~ Statutes. <br /> <br />2.5 Severability <br /> <br />If any section, clause, provision, or portion of this ordinance is adjudged unconstitutional or <br />invalid by a court of c0l'1'ÌRetent jurisdiction, the remainder of this ordinance shall not be affected <br />thereby. <br /> <br />2.6 Abrogation and Greater Restrictions <br /> <br />It is not intended by this ordinance to repeal, abrogate, or impair any existing easements, <br />covenants, or deed restrictions. However, where this ordinance imposes greater restrictions, the <br />provisions of this ordinance shall prevail. All other ordinances inconsistent with this ordinance are <br />hereby repealed to the extent of the inconsistency only, <br /> <br />SECTION 3.0 - ADMINISTRATION <br /> <br />3. 1 Enforcement <br /> <br />The Community Development Director is respongjbJe for the overaJJ administration and <br />enforcement of this ordinance.
