CompliR!1ce with Laws and Regulations <br /> <br />The DEVELOPER represents to the CITY that the proposed Development complies with all City, <br />County, Metropolitan, State, and Federal laws and regulations, including but not limited to: <br />Subdivision Ordinances, Zoning Ordinances and Environmental Regulations. The DEVELOPER <br />agrees to comply with such laws and regulations. <br /> <br />6. Rezoning. <br /> <br />The CITY conducted hearings to consider the rezoning of the Subject Property rrom R~2 Two Family <br />Residential and R-3A Multiple Family Residential, to PUD Planned Unit Development. The CITY <br />agrees to rezone the Subject Property to PUD, subject to the DEVELOPER'S strict compliance with <br />the approved plans, and the terms and conditions of this agreement. (Minor variations from the <br />approved plans may be approved by the CITY's Design Review Committee, under the direction of <br />the Community Development Director). Substantial departures from the approved plans will require <br />an amendment to the Planned Unit Development, in accordance with Section 17 of the RosevilIe <br />Zoning Ordinance. Failure by the DEVELOPER to commence development activity, in accordance <br />'With the Final Development Plans, within one year following the final approval of this Planned Unit <br />Development, will necessitate the approval of an extension ofthe development schedule by the City <br />Council prior to the expiration of the one year period. If an extension is not applied for, the Council <br />may instruct the Planning Commission to initiate rezoning to the original zoning district. <br /> <br />7. Additional Conditions of Approval. <br /> <br />To insure that the proposed development meets the City's standards for the approval of a planned unit <br />development, as set forth in Section 17 (Roseville) Zoning Ordinance, the Development shall also <br />comply with the following conditions: <br /> <br />a. Sign designs must be part ofPUD and in the form of a monument sign meeting the <br />sign code. <br />b. Drainage plan details must be approved by the City Engineer before the City Manager <br />and Mayor will sign the document. <br />c. Conifers or other low, year round plantings, must be planted in area originally used <br />for parking spaces 1 and 2 (spaces 1 and 2 are to be removed). <br />d. Handicapped parking spaces must be designated on original spaces 3 and 4, and add <br />more parking on expanded spaces 18 and 19. <br />e. A complete landscape plan must be submitted, including attempts to save as much <br />vegetation along south and west property edges as possible. Any trees taken down <br />in this area must be replaced on site. Plantings must include 5% coverage in the <br />parking lot. <br />f. Trash enclosures must be approved by the City Planner. <br />
