<br />REQUEST FOR COUNCIL ACTION <br /> <br />DATE: 02-27-95 <br /> <br />ITEM NO.: G-6 <br /> <br />Manager Reviewed: <br /> <br />Agenda Section: <br /> <br />Department Approval: <br /> <br /> <br />Hearin <br />Ken Kath request for a special use permit for the rental and leasing of <br />automobiles and appeal for a night watchman facility at 2611 Hamline <br />Avenue North. <br /> <br />~~ <br /> <br />Background <br /> <br />1. As we indicated to the Commission at the January 1995 meeting, Mr. Kath began <br />construction of a spec retail building, approximately 20,000 sq. ft. in size on the property <br />located in the southwest quadrant of Hamline Avenue and County Road C during the <br />summer of 1994. The shell is completed at this time and is awaiting tenant finish out. The <br />property is zoned B-3 General Business and most retail uses are permitted uses in that <br />district. At the January meeting, Mr. Kath presented plans for a 1400 sq. ft. single family <br />residential unit with an 866 sq. ft. garage attached to it. It was Mr. Kath's position that <br />this was a night watchman's residence and that under Section 8.235 of the Rosevi1le <br />Zoning Ordinance, he felt it was a permitted accessory use in this business district. The <br />Planning Commission indicated that it was the Commission's feeling that the size of the <br />facility was more than a night watchman's residence. Mr. Kath appeared before the City <br />Council with a proposal that reduced the residential unit down to 570 sq. ft. with the <br />attached 866 sq. ft. garage. The Council directed Mr. Kath to return to the Planning <br />Commission with this revised plan to develop a definition of a night watchman's residence <br />and to refine the definition. <br /> <br />Proposed Definition <br /> <br />The staff prepared the following definition of a night watchman's residence which is a <br />permitted use in a business district: <br /> <br />a. Such a space is an accessory use to be used for office and living area for a person <br />to fulfill the duties as night watchman in the primary structure and principle use. <br /> <br />b. Such space is to be limited to 600 sq. ft. or less of combined living and office <br />space. <br /> <br />c. The living area is to be the equivalent of a studio apartment, to be occupied only <br />by the watchman as designated by the building owner/property manager (not to be. <br />used as a separate rental dwelling unit). <br /> <br />d. The watchman's residence must be an integral part of the principle structure (not <br />an add-on or separate structure). <br />
