The Planning Commission, at tbe February 8, 1995 meeting, continued Kenneth <br />Katb's request for a special use permit for leasing and rental of automobiles to the <br />March 8,1995 Planning Commission meeting, to allow statTtime to review 6 criteria <br />and 6 conditions. The Planning Commission also recommended tbat the staff and <br />City attorney review other ordinances, case law, the origins of night watchman <br />provisions in the ordinance, and prepare a definition of night watchman and night <br />watchman's residence and submit this to the City Council for a change in the City <br />Code. Commission members later expressed concern about the proposed residence <br />allowing the applicant/owner to "homestead" a portion of the strip center for <br />property tax purposes. <br /> <br />3. The City Attorney prepared background on the night watchmman's residence (2/21/95 <br />attached) recommending issuance of building permits for the night watchman's quarters. <br /> <br />Staff Recommendation: <br /> <br />I. Staff recommends that the City Council continue consideration of the Kath special use <br />permit for leasing and rental of automobiles until the March 27, 1995 City Council <br />meeting. <br /> <br />2. The definition of a night watchman's residence has been reviewed by the City Attorney <br />(see attachment). At a later date, the City code should be revised to include the definition <br />as finally approved by the Council. <br /> <br />Council Action Requested: <br /> <br />1. Motion to continue consideration of the Kath special use permit for leasing and rental of <br />automobiles and night watchmants residence until the March 27, 1995 City Council <br />meeting. <br /> <br />2. Motion to approve the 570 sq. ft. watchmants quarters per the definitions as submitted by <br />the staff: <br /> <br />a. Such a space is an accessory use to be used for office and living area for a person <br />to fulfill the duties as night watchman in the primary structure and principle use. <br /> <br />b. Such space is to be limited to 600 sq. ft. or less of combined living and office <br />space. <br /> <br />c. . The living area is to be the equivalent of a studio apartment, to be occupied only <br />by the watchman as designated by the building owner/property manager (not to be <br />used as a separate rental dwelling unit). <br /> <br />d. The watchman's residence must be an integral part of the principle structure (not <br />an add-on or separate structure). <br />
