City cod~ Qoes not have a definition of a night watchman's <br />I'esidence, nor does it have any criteria regarding the si2e, <br />location, etc. Accordingly, the standard to be applied is a <br />IIreasonableness" standard. Applications would be judged based upon <br />what the Planning commission and council oonsider to ~e reasonable <br />anal if imposition of those standa~ds are based upon legitimate <br />munioipal ooncerns, the City's action would be defensible. <br /> <br />.' <br /> <br />A legitimate ooncern that the City is currently being faced <br />with involving night watchmen's residenoes is an application where <br />the re"io.ence Wa.8 in exce158 of 2 I 000 square feet. In the.t <br />situation, you and I r.oommandad to the Pl~nn~ng Commission and the <br />applicant that suoh a large~sizeQ night watchman's residence would <br />probably end up eventually being a non-conforming use rental <br />apartment or owner-ocoupanoy apartment and not a night watchman's <br />-residence! because it was not reasonable that a business would <br />provide a 2,000 .equare foot apartment for ite night watchman. <br /> <br />Based upon that advio~1 the applicant reduced the size of the <br />night watchman's residence to less than 600 square feet which we <br />both be11eve~ was in keep1ng w1th the n1ght watchman's residence <br />use. <br /> <br />In that case, the owner indicated that he intends to be the <br />night watchman and was planning on living in the night watchman's <br />resiaence while pertorming that function. It is my opinion that <br />the City doe a not have authority to precl~de the owner from being <br /> <br />~ <br />
