I do not have the benefit of knowing the precise location that you seek to have covered by the easement agreement and, accordingly, I cannot ascertain the accuracy of the legal descriptions. Assuming, however, that those legal descriptions do cover the area intended to be covered, the easement agreement is in the proper form and in order for execution. I do note, however, that the agreement only has a space for execution by the Mayor of the City. Pursuant to statute, the document should be executed by the Mayor and the City Manager. By copy of this letter to Attorney John Kuehn, I request that he revise the agreement amending right-of-way easement to include a line for the signature of the City Manager, as well as a modification to the notary language, including the City Manager. I am retaining the deeds and I am having them filed with the Ramsey County Recorder.
