The app1ioation will be the sched~le of values of work inc:luding quantities and unit prices as stipulated in the, contrac~ dooument and measured by the ENGINEER'S representatives or the ENGINEER. The ENGINEER will, within fifteen days after receiving an application for progress payment approved by the CONTRACTOR and the ENGINEER" present, ,the appl ication to the OWNER for payment.. If the CONTRACTOR does, not agree with the quantities,or'prices on the' application, the CONTRACTOR will supply the, ,ENGINEER with written documentation as to the basis of the disagreement., No payment will 'be made until both parties agree on the information shown on the application.. . I~ payment is requested on the basis of materials and equipment not incorporated in the Work but delivered and suitably stored at the site or at another location agreed to in writing, the Application for Payment shall also be accompanied by such supportinq data, sati~factory to the OWNER, as will establish the OWNER'S title to the material and equipment and protect his interests therein.. The CONTRACTOR by signing the applica~ion warrants that he and all his Subcontractors have and will maintain good title to all materials and equipment incorporated in the Project and all material and equipment otherwise listed in an Application for Payment, free, and clear of all liens, claims, security interests ana encumbrances; and he will not acquire nor permit any Sub- contractor to acquire any such material and equipment subject to any agreement under which an interest therein or "encumbrance thereon is retained by the seller or' otherwise imposed by the CONTRACTOR. The ENGINEER will, within fifteen days,:after receipt of each Application for Payment indicate in writing his approval of payment and present the Application to the OWNER, or return the Application to the CON'1'RAC'l'OR indicating in writinq his reasons for refusing to approve payment. In the latter case, the CONTRACTOR may make the necessary corrections and,re-submit the Application.. The OWNER will within fifteen days after presenta- tion to him of an approved Application for Payment, pay the CONTRACTOR the amount approved .by the, :ENGJ:NE~R. All monies not paid when due hereunder sha1l..bear interest at the rate of five per cent (5%) ,per annum commencing on the first day after the payment is due and continuing until-the payment is made.
