Mr. Torgerson appeared before the Planning Commission at the May 8th, 1995, meeting <br />seeking a 25 foot front yard setback variance at 337 South Owasso Boulevard. At that <br />meeting it was pointed out that the site under consideration is approximately 7,000 square <br />feet in size and is one of the cabin lots located on the east side of Lake Owasso on the <br />private road on the Burlington Northern Railroad right~of-way. The zoning is R~l, single <br />family, and the Comprehensive Plan guides this area for low density development. The <br />site is subject to the Shoreland ordinances. The house at this location was built in 1938, <br />and, as with its neighbors, did not pay much attention to building setbacks. The existing <br />garage is located partially within the railroad easement. The proposal by Torgerson was <br />to raze the garage and deck to allow additional living space and an attached 20 foot wide <br />garage. The new house would be entirely within the lot boundaries and, importantly, <br />would not be closer to the lake shore than the existing structure. <br /> <br />2. In recommending approval of Mr. Torgerson's request for a 25 foot front yard (south side, <br />away from the lake) setback, the Planning Commission offered the following findings and <br />recommendations: <br /> <br />WHEREAS the front yard setback of the Torgerson house is setback from the railroad <br />right~of-way and not a public road, and has little impact on the driving public, and whereas <br />the existing cabin is small, not liveable by current standards, and <br /> <br />WHEREAS houses in the neighborhood have similar setbacks from the railroad right-of- <br />way, now therefore, <br /> <br />BE IT RESOLVED to recommend approval of the John Torgerson 25 foot front yard <br />setback to allow a new garage to set within 5 feet of the front property line provided the <br />applicant secures a letter of approval from the existing owner. <br /> <br />3. Based on this recommendation and the Council's approval of the front yard setback <br />variance, Mr. Torgerson completed the transaction for the purchase of this property.
