consultants have thoroughly looked into the condition of the existing house and have
indicated to Mr. Torgerson that the condition and design of the existing cabin foundation
does not provide the strength or structural integrity to support the roof system and the
connection to the proposed addition. It is the consultant's recommendation that the best
approach to this site would be to raze the entire structure and rebuild a new structure on
the site. This is similar to concerns raised by members of the Planning Commission during
the deliberation on Mr. Torgerson's request in May. Mr. Torgerson has looked at designs
for new houses that would maintain the current setback from the shoreline and stay within
side yard setback requirements and be at least 5 feet ftom the front yard property line and
is now requesting that the Commission consider modifYing his approval to include
construction of a new house within those building limits.

4. The Planning Commission, at the August 9, 1995 meeting, recommended approval
of John Torgerson ts request for a variance at 337 South Owasso Boulevard, to
allow the existing structure to be torn down and a new structure to be built at the
same 21 foot setback from the shoreline for the foundation wall of the house and
with a 15 feet setback from the Lake Owasso shoreline for the deck, and 5 feet for
the south or front property line setback for a garage, but requiring a 5 foot
minimum setback on both side lot property lines. The motion reads as follows:

Resolution 8/9/95a

Chairman Wietecki offered the following motion which was seconded by Member Harms.

WHEREAS, Burlington Northern Railroad right~of-way forms the ftont or south
property line along the structure and lot at 337 South Owasso Boulevard, and

WHEREAS, the front or south side setback from the Burlington Northern railroad right-
of-way front property line is five feet, and

WHEREAS, the Burlington Northern railroad right-of~way prohibits further encroachment
or further development, and

WHEREAS, the lot area is consistent with adjacent properties, and the proposed structure
will be set back from the shoreland a distance similar to adjacent structures, and

WHEREAS, the proposed structure would encroach no closer than the existing
structurally unsound structure to Lake Owasso's shoreline, now

THEREFORE, BE IT RESOLVED, that the City ofRoseville Planning Commission
recommends approval of a variance to John Torgerson at 337 South Owasso Boulevard,
to allow the existing structure to be torn down and a new structure to be built at the same
21 foot setback from the shoreline for the foundation wall of the house and with a 15 feet
setback from the Lake Owasso shoreline for the deck, and 5 feet for the south or front
property line setback for a garage, but requiring a 5 foot minimum setback on both side lot

2
