property lines.

Staff Recommendation:

L The property at 337 South Owasso Boulevard was platted and constructed in 1938. Mr.
Torgerson's proposal in May was to improve the site by adding living space and an
attached garage to the house with the proposed structure staying beyond the 5 foot side
yard setback requirements and by not encroaching further into the lake shore setback area.
His plan would have removed the existing detached garage ITom the railroad tight~of-way.
Due to structural problems associated with the existing cabin structure, Mr. Torgerson has
been advised that he would be better served by razing the existing structure and starting
fresh with new construction. Building inspection staff have reviewed this information and
concur with these findings. Therefore, staff recommends approval of Mr. Torgerson's
request to modify his variance application to include the reconstruction of the existing
cabin structure on this site within the building area defined by the approved variance
request.

Council Action Requested:

L Motion to approve John Torgerson's request for a variance at 337 South Owasso
Boulevard, to allow the existing structure to be torn down and a new structure to be built
at the same 21 foot setback from the shoreline for the foundation wall of the house and
with a 15 feet setback from the Lake Owasso shoreline for the deck, and 5 feet for the
south or front property line setback for a garage, but requiring a 5 foot minimum setback
on both side lot property lines.

Staff Report by: Michael Falk

3
