Orton <br /> <br />and a residue certificate of title was entered as Certificate of Title No. 115598 for the following <br /> <br />described land: <br /> <br />All of Lot 15, Auditor's Subdivision No. 40, Ramsey County, Minnesota, except <br />the South 516.54 feet except the East 47.5 feet and also except the Sou th 330. 14 <br />feet of the East 47.5 feet thereof. <br /> <br />As a resull of this change in the legal description, creating the gap as noted ahove, fee <br /> <br />title to the gap is still owned by Irvin J. Orton and Alta R. Orton, husband and wife, as joint <br /> <br />tenants. <br /> <br />8. <br /> <br />(1 assume there will be evidence at the hearing to support a finding of fact that) it was <br /> <br />the intent of said Irvin J. Orton and AIta R. Orton to convey all of their interest when they <br /> <br />subsequently conveyed the land described on Certificate of Title No.1 15598. <br /> <br />9. <br /> <br />Notice of this proceeding should be given to Irvin .T. Orton and Alta R. Orton [fee <br /> <br />owners] and to parties, if any. in possession of said land adverse to the petitioner herein. said <br /> <br />nOlice to be by service upon them of an Order to Show Cause returnable before this court at <br /> <br />2:00 o'clock P.M. of a Wednesday to be therein designated. <br /> <br />(The matter of occupancy or lack of it should be covered by evidence at the hearing <br /> <br />and a finding of fact) <br /> <br />A- <br />
