..

of Tract A that is a combination of a 30 ft. scenic easement and a 20 ft. water line
easement (10 ft. is shared by both easements). It should be noted that no building may be
built on this easement on Tract A.

4. The Engineering Department has reviewed this proposal for a lot division at 2250 Acorn
Road and has the following recommendation. There are currently deferred assessments
for Sanitary Sewer 3 in the amount of $2, 103.74 and for Watermain in the amount of
$1,523.58 which must be paid if division is approved. There are no other engineering
concerns at this time.

5. The Planning Commission, at the August 9,1995 meeting, recommended approval
of Gary and Elizabeth Boryczak's request for a platted land at 2250 Acorn Road
with the conditions stated by the engineering staff to pay the deferred assessments
and with the condition that the utility easements along the new property lines be
shown on the survey.

Staff Recommendation:

1. The site under consideration is approximately 63,000 sq. ft. in size and is zoned R-l Single
Family. The proposed lot division will create a new single family lot in the City of
Roseville. Both lots exceed the minimum size and frontage requirements for single family
development and will not require variances for single family construction. Therefore, it is
staffs recommendation that Mr. and Mrs. Boryczka's request for a division of a platted lot
at 2250 Acorn Road be approved.

Council Action Requested:

1. Motion to approve Gary and Elizabeth Boryczak's request for a platted land at 2250
Acorn Road with the conditions stated by the engineering staff to pay the deferred
assessments and with the condition that the utility easements along the new property lines
be shown on the survey.

Staff Report by: Michael Falk

2
