<br />, <br /> <br />AGREEMENT TO PROVIDE ROAD AND UTILITY EASEMENT <br /> <br />THIS AGREEMENT, made this _ day of , 19_, by and between the <br />Calvary Baptist Church of St. Paul, of the County of Ramsey, State of Minnesota, (hereinafter <br />"Church"), having an address at 2120 Lexington Avenue, party of the first part, and CITY OF <br />ROSEVILLE, Ramsey County, Minnesota, a municipal corporation, party of the second part, <br /> <br />WHEREAS, the Church has applied for a building permit to increase the square footage <br />of their church, and <br /> <br />\VHEREAS, such addition will increase the size of the congregation and therefore the <br />amount of traffic to and from said church from adjoining Lexington A venue, and <br /> <br />WHEREAS, by reason of the above, the City has determined that it may become <br />necessary, at some time in the future, to ~ Lexington Avenue, <br />l t-\oJ;+y <br />NOW THEREFORE, in consideration of the above factors and for $1.00 in additional <br />consideration, the parties hereby agree as follows: <br />~fV\oJ~.fy ^+ <br />1. At whatever time the Ci y of Roseville or Ramsey County or both, jk their sole <br />discretion, decide to Lexington Avenue, then the Church will, without <br />further consideration, promptly execute an easement to either the City of <br />Roseville or Ramsey County (depending on which governmental entity will <br />~ Lexington Avenue) on the form attached as Exhibit A. <br />L f.,.oJ.'fy <br /> <br />2.
