, AGREEMENT TO PROVIDE ROAD AND UTILITY EASEMENT THIS AGREEMENT, made this _ day of , 19_, by and between the Calvary Baptist Church of St. Paul, of the County of Ramsey, State of Minnesota, (hereinafter "Church"), having an address at 2120 Lexington Avenue, party of the first part, and CITY OF ROSEVILLE, Ramsey County, Minnesota, a municipal corporation, party of the second part, WHEREAS, the Church has applied for a building permit to increase the square footage of their church, and \VHEREAS, such addition will increase the size of the congregation and therefore the amount of traffic to and from said church from adjoining Lexington A venue, and WHEREAS, by reason of the above, the City has determined that it may become necessary, at some time in the future, to ~ Lexington Avenue, l t-\oJ;+y NOW THEREFORE, in consideration of the above factors and for $1.00 in additional consideration, the parties hereby agree as follows: ~fV\oJ~.fy ^+ 1. At whatever time the Ci y of Roseville or Ramsey County or both, jk their sole discretion, decide to Lexington Avenue, then the Church will, without further consideration, promptly execute an easement to either the City of Roseville or Ramsey County (depending on which governmental entity will ~ Lexington Avenue) on the form attached as Exhibit A. L f.,.oJ.'fy 2. The easement width will be no more than 16.5 feet and maybe less, as the City of Roseville or Ramsey County, in their sole discretion shall determine is necessary . 3. The Church agrees that it will not place any above ground structure over the easement area described in Exhibit A nor suffer any incumbrance to be placed on the easement area described in Exhibit A.
