REQUEST FOR COUNCIL ACTION

DATE: 09-25-95

ITEM NO.: G-3

Department Approval:

~/4

Item Description:

Manager Reviewed:

Agenda Section:

Hearing
Mark Bowser request for a division of a platted lot at 1055 W. Shryer
Avenue.

Background

1. Mark and Melanie Bowser own property at 1055 W. Shryer Avenue. The property has
128.31 feet ofrrontage on Shryer Avenue and is 298.17 feet deep. Given the size of the
property, it is the Bowser's desire to create two lots by subdividing the property with a
flag lot configuration.

2. The property the Bowser's would like to divide is 38,258 sq. ft. in size and is zoned R-l
Single Family. It has 128.31 feet of frontage along Shryer Avenue. Like adjacent lots
along Shryer Avenue and lots on the south side of Parker, the Bowsers have an
exceptionally deep lot.

Lot Standards

Lot Size

Lot Width

11,000 sq. ft.

85 feet minimum

Bowser Proposal

Parcel A
Parcel B

19,600 sq. ft.
18,658 sq. ft.

103.3 feet
25 feet

3. Parcel B is proposed to be a flag lot. The City's code does not have provisions for flag
lots, however, it has been the City's past policy to consider flag lots where this
configuration is the only opportunity to provide access to developable property. In those
cases, the City has required a 30 foot wide opening to a public street. This provides an
opportunity for a 20 foot wide driveway with a 5 foot setback on either side. With this
design, any siting of a home on this lot would create a "front door view" facing either a
side or rear yard of adjoining properties. To some neighbors this raises the concern about
backyard privacy

4. The Bowser's application for the division of their lot with a flag lot configuration also
includes their request to vary rrom the policy of30 feet ofrrontage on a public street.
Their proposed lot design shows 25 feet offrontage on Shryer and they have indicated
that the driveway would be no wider than 15 feet.

1
