<br />5. Future Considerations - All of the lots that are on the north side ofShryer Avenue and on <br />the south side of Parker, east of Lexington toward Victoria, are deep lots. It may be <br />possible for these neighbors to agree on a development plan that would provide access to <br />these rear yard properties affording the opportunity for several more single family lots <br />each facing a public street. Siting a home on a flag lot with the rront of the house facing <br />away rrom a potential future street, may limit this opportunity. <br /> <br />6. Engineering Considerations - The Engineering Dept. has reviewed this proposal and has <br />made the following recommendations: <br /> <br />a. The width of the lot extending back to the new rear lot is only 25 feet and it has <br />been City policy that flag lots need to have no less than 30 feet. <br />b. If this division is approved, there are assessments that would have to be paid <br />totalling $3,820.90. <br />c. This lot would have a water service that is over 260 feet long and would have to <br />use 1-1/2 or 2 inch copper water service. <br />d. The sanitary sewer service can be connected to the existing line located in the <br />northwest corner of the lot. <br />e. The existing concrete curb and gutter will have to be cut away for any new <br />driveway. This must be done as per City standards. <br /> <br />7. The Planning Commission, at the September 13, 1995 meeting, unanimously <br />recommended denial of Mark Bowser's request for a flag lot and further <br />recommended to the City Council and Manager to establish a moratorium on flag <br />lots during which time standards for flag lots should be investigated and adopted. <br /> <br />Staff Recommendations: <br /> <br />1. The City code does not have provisions for flag lots. However, it has been the City's past <br />policy to consider flag lots where this configuration is the only opportunity to provide <br />access to developable property. In cases where the City has considered such applications, <br />concerns about rear yard privacy of adjoining properties is taken into consideration. In <br />this case, staff has heard from adjoining neighbors who are concerned about this issue. <br />The other concern would be whether or not this lot division and the placement of the <br />house on a flag lot would limit future potential development of rear lot areas in this <br />neighborhood. Based on these concerns, staff recommends denial of the Mark and <br />Melanie Bowser request for a division of a platted lot at 1055 Shryer Avenue. <br /> <br />Council Action Requested: <br /> <br />1. Motion to deny Mark Bowser's request for a flag lot at 1055 W. Shryer Avenue. <br />2. Motion to authorize the staff and Planning Commission to study potential flag lot <br />standards. <br />3.
