Planning Commission Minutes
November 8, 1995

Jim Westby, 480 Lovell Avenue, stated he had no concern with the parking on Sundays
and no problem with the children using the area east of the Temple. In fact, the Westby
property has been used for parking and volleyball. He objected to the fence.

Temple representatives stated that they appreciate the help of the neighborhood. They
noted that Mr. Westby had invited parking and play area to take place on his property.
The Temple Association will build portions of the addition to discourage the children rrom
going to the Homeowner's Association pond area as they are also concerned about the
safety of their children.

There were no further comments. Chairman Keith Wietecki closed the public hearing.

Member Rhody stated that the Temple gave up open space to the west when the Villa
Association construction occurred. The Temple supported the townhomes as they are
currently designed. The Temple has been improved since the Buddhist Association took
over the site. He expressed concern that there was water in the pond and recommended
that the Townhome Association build their own fence.

Chairman Wietecki asked if the property owners have the right to put a fence or building
on the easement. (No) He asked what the unusual hardship or practical difficulty would
be with the rear yard setback. Michael Falk responded that the configuration of the
courtyard and building make it important for meditation. There is no other location on the
site for this courtyard.

MOTION: Member Thein moved, seconded by Member Harms, to recommend approval
of the variances requested by Khuyen Nguyen/Vietnamese Buddhist Association, located
at 475 Minnesota Avenue with the following conditions:

a. The west side of the property be landscaped as approved by the staff
b. The outdoor materials be cleaned up.
c. Design and materials for the addition be approved by the planning staff with the
Planning Commission encouraging the use of brick and higher quality materials.

Roll Call:

Ayes:

Wietecki, Thein, Harms, Cunningham, Rhody, Wall

Nayes: None

Member Wall asked the staff to recommend and establish the basis for all future variances.

7.

(a)

Discussion of church land use criteria in residential districts.

MOTION: Member Harms moved, seconded by Member Wietecki to recommend the
establishment of a subcommittee to study the church land use criteria within residential
districts.

7
