<br />CITY ORDINANCE: City ordinances indicate that beauty parlors with one operator <br />which see customers by appointment only are uses allowed by conditional use permit in <br />the R-l zoning district. The ordinance also indicates that beauty shops must meet the <br />restrictions outlined in the home occupation section of the code which limits the home <br />occupation to one room in the principal dwelling; prohibits the employment of any persons <br />not residing in the residence; and prohibits retail or wholesale products sales on the site. <br />The ordinance also states that the Council may approve the equipment used. Ms. Alberg <br />has indicated that she will abide by all of the ordinance requirements. <br /> <br />PROPOSED DEVELOPMENT: Ms. Alberg's operation will certainly not be a <br />commercial or business use in the normal sense of the word. With one operator and one <br />customer at a time by appointment only, the disruption to the neighborhood will be barely <br />noticeable. It is not an encroachment of typical commercial activity into the neighborhood <br />and in staff's opinion, this part time use of a facility currently in place in Ms. Alberg's <br />home meets the criteria in the City code for the issuance of a conditional use permit. In <br />past considerations of requests for conditional use permits for one operator beauty salons <br />in residential districts, the Planning Commission has considered the following additional <br />conditions of approval: <br /> <br />1. Defining the hours business is conducted during the week. <br />2. Stipulating that there shall be no more than two client cars at a time and that those <br />cars must be parked off street. <br />3. That the conditional use permit is issued to the applicant only and shall <br />automatically expire upon the sale of the property. <br />4. That there shall be no product sales on the site except sale of products to <br />individuals at the time the service is rendered if appropriate. <br />5. That there shall be no other employees providing service and that the business shall <br />not occupy more than one room of the house. <br />6. That the structure must meet life safety exiting criteria of the City Codes. <br />7. That the non-lighted sign be no more than 3 square feet. <br />8.
